These are the contractual terms of use for the Cars24 online content, data and functionality (our “services”). If you browse, access or use any such content, data or functionality (together referred to as our “services”), you agree to be bound by these terms. If you do not agree to these terms, you must not access or use our services.

You are also responsible for ensuring that all persons who access or use our services through your internet connection or longin are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

Our services are directed to people residing in Australia. We do not represent that content available on or through our services is appropriate for use or available in other countries.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

How you may use content and data provided through our services

We are the owner or the licensee of all intellectual property rights in content and data provided through our services. Those works are protected by the Australian Copyright Act 1968 (Cth). All such rights are reserved.

Please note that we only provide our services for domestic and private use. You must not use any part of the content or data provided through our services for commercial purposes without obtaining a licence to do so from us or our licensors.

If you breach these terms of use, your right to access and use our services will cease immediately.

Technical restrictions on use of our services

In accessing or using our services, you agree that you will not:

  • use any automated device, software, process or means to access, retrieve, scrape, or index our platform or any content;
  • use any device, software, process or means to interfere or attempt to interfere with the proper functioning of our services;
  • undertake any action that will impose a burden or make excessive demands on our infrastructure that we deem, in our sole discretion to be unreasonable or disproportionate usage;
  • use or index any of our content or data for purposes of:
    • constructing or populating a searchable database of cars,
    • building a database of car-related information; or
    • competing with us in any manner that we have not specifically authorised;
  • transmit spam, chain letters, contests, junk email, surveys, or other mass messaging, whether commercial in nature or not;
  • use our services or any of our content in any manner which is, in our sole discretion, not reasonable and/or not for the purpose which it is made available;
  • violate the rights of any person, including copyright, trade secret, privacy right, or any other intellectual property or proprietary right;
  • pose as any person or entity or attempt to solicit money, passwords or personal information from any person;
  • act in violation of any term of use or other condition posed by us or any applicable law;
  • transmit or attempt to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature;
  • attempt to gain unauthorised access to our services or the server from which our services are provided; or
  • attack our online services via a denial-of-service attack or a distributed denial-of service attack.

We reserve the right to exercise whatever means we deem necessary to prevent unauthorised access to or use of our services, including, but not limited to, instituting technological barriers, or reporting your conduct to any person or entity.

Our registered trademarks

“Cars24” and the Cars24 logo are our trademarks in Australia and globally. You are not permitted to use our trademarks without our written approval.

Editorial content

Any editorial content or articles published via our services are of a general nature only and do not consider your personal objectives, financial situation or particular needs. Editorial content should not be regarded as advice or relied upon by you or any other person and we recommend that you seek professional advice before acting on the content.

We are not responsible for websites we link to

Where our online services include links to websites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those third party websites or resources.

User-generated content is not approved by us

Our services may include information and materials uploaded by other users. This information and materials have not been verified or approved by us. The views expressed by other users do not represent our views or values.

How to complain about content uploaded by other users

Our responsibility for loss or damage suffered by you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We exclude all implied conditions, warranties, representations or other terms that may apply to our services or any content or data we provided as part of our services.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our services; or
  • use of or reliance on any content displayed via our services.

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue; or
  • business interruption; or
  • loss of anticipated savings; or
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

As noted above, we only provide our services for domestic and private use and you agree not to use our services for any commercial or business purposes. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

How we may use your personal information

Our Privacy Policy sets out how we use your personal information.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our online services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our services. You should use your own virus protection software.

Which country’s laws apply to any disputes?

These terms of use, their subject matter and their formation, are governed by the laws of Victoria, Australia. You and we both agree that the courts of Victoria will have exclusive jurisdiction.

Cars24 Marketplace

Purpose: The primary purpose of Cars24 Marketplace (“Platform”) is to provide car sellers/dealers/vendors (“Marketplace Sellers”) an online marketplace/e-commerce platform so that they can list their cars online and connect directly with car buyers (“Marketplace Buyers”) via our Platform - Cars24 Marketplace.

All Marketplace Sellers and Buyers and registered users of this website will be termed under “User” or “User Accounts” for the purposes of terms and conditions applicable to the Platform.

Eligibility: Users must be at least 18 years of age and legally entitled to buy and sell motor vehicles in Australia in order to access this Platform. All Marketplace Sellers must hold a valid LMCT (Licensed Motor Car Trader) licence or equivalent required under the relevant state law.

Prohibitions: Users must not-

  • Post inaccurate, false, or misleading content.
  • List or sell stolen, unsafe, or non-compliant vehicles.
  • Circumvent the Platform to avoid applicable fees.
  • Harass, defraud, or mislead other users.
  • Upload any content that infringes intellectual property or breaches privacy laws.
  • Copy/duplicate the data or content as seen on the platform

User Accounts: the terms and conditions applicable on listings are-

  • All Users are permitted to list or purchase vehicles on the Cars24 Marketplace.
  • All Users must register an account with accurate and up-to-date information.
  • All Users are responsible for safeguarding their account credentials and all activity under their account.
  • Cars24 may suspend or terminate any user account for non-compliance, misuse, or any fraudulent activity as per due diligence.

Listings by Marketplace Sellers: the terms and conditions applicable to User Accounts are-

  • Sellers/Dealers/Vendors must provide complete and accurate details of each vehicle, including VIN, odometer reading, PPSR, accident history, warranties, and any encumbrances.
  • Listings must comply with the Australian Consumer Law (ACL) guarantees and relevant state/territory motor dealer legislation.
  • Duplicate, false, misleading, or unlawful listings are prohibited and will be removed by Cars24 upon due diligence.
  • Cars24 reserves the right to edit, refuse, or remove listings that breach these Terms.

Marketplace Buyer Responsibilities: the terms and conditions applicable on buyers at Cars24 Marketplace are-

  • Marketplace Buyers must conduct their own due diligence, including independent inspections and vehicle history checks.
  • independent inspections and vehicle history checks. Cars24 can not guarantee the accuracy, quality, or completeness of listings.
  • All purchase and payment arrangements are strictly between the Buyer and Seller and outside the scope of responsibility of Cars24, unless otherwise expressly stated.

Fees and payments: terms and conditions applicable on fees and payment concerning the Platform are-

  • All prices are inclusive of GST unless otherwise specified.
  • Cars24 may charge listing fees, subscription fees, promotional upgrade fees, or service charges as published on the Platform.
  • Payment for vehicle purchases must be arranged directly between Buyer and Seller. Cars24 does not act as a payment intermediary unless explicitly stated in writing.

Role of Cars24: terms defining the role of Cars24 on the Platform are -

  • Cars24 Marketplace is a facilitation and advertising platform only.
  • Cars24 or Cars24 Marketplace is not a party to any vehicle sale agreement, unless stated specifically and signed by Cars24.
  • Marketplace Sellers remain solely responsible for warranties, statutory guarantees, and legal compliance.
  • Cars24 is not responsible for any price fluctuation on the Platform.
  • Marketplace Sellers remain solely responsible for warranties, statutory guarantees, and legal compliance.
  • If any goods and services are offered on the Cars24 platform by third parties or Marketplace Sellers, to the extent permitted by law, following terms and conditions will apply:
    • Vehicle prices often exclude delivery, government and statutory charges (always check with the Marketplace Seller or User Account);
    • Users are responsible for making all relevant searches, enquiries and investigations in relation to the goods and services including searching any written off vehicle register or register of security interests (including the Personal Property Securities Register);
    • Cars24 does not act as any person’s or User’s agent or broker, arrange any contract between User and any person, or provide any warranty in relation to any person’s or User’s goods or services (unless specifically stated); and
    • Cars24 will not be responsible for the terms of any transaction between User and any person, any goods or services purchased by any person or User from any User Account, or for resolving any dispute between User accounts and any person or between any such parties.
  • Cars24 may augment information supplied by Marketsellers or User Accounts, for example by using the make, model and series provided by a seller to suggest vehicle features. This information depends upon the Marketplace Seller’s accuracy on identifying their vehicle and also on information provided to Cars24 Platform from third parties (for example original equipment manufacturers). Whilst Cars24 requests that sellers check this information, such information may still be inaccurate. Cars24 strongly recommends that you check with the Marketplace Seller that all information contained in an advertisement or listing is accurate before any User or person make any purchase.

Liability disclaimer: Cars24 is not liable for any loss, damage, fraud, misrepresentation, or dispute between Marketplace Buyers and Sellers. Cars24’s liability (if any) is limited to the fees paid by the user in the preceding 6 months, except in cases of gross negligence, fraud, or wilful misconduct.
